Information provided to the interested party in accordance with Article 13 of Legislative Decree No. 96/2003 “Personal data protection code”

We hereby inform you of the following details, in compliance with Article 13 of Legislative Decree No. 196/2003 and in relation to the personal data intended to be processed:

1. Sources and Purposes

The personal data requested or provided, or obtained directly from the interested parties, also verbally, or collected from third parties, obtained mainly at the date the contractual relationship was established or during or after termination thereof, is subject to processing for the purposes associated with the contractual relationship with COOPER CSA, namely:

  • execution of pre-contractual negotiations and negotiations to enter into agreements;
  • management of the contractual relationship established and in force with COOPER CSA (for purposes of illustration, invoicing, requests for services, etc...);
  • fulfilment of legal obligations associated with civil, tax and accounting provisions

All the data as detailed in point 2) below, will be preserved also after termination of the contractual relationship to execute all fulfilments, if applicable, associated with or deriving from termination of the relationship in question.

2. Types of data

The personal data categories refer to general data contained in public registers or however in deeds or documents which may be known by anyone (company name, address, VAT reference No., etc.).

3. Processing

“Processing personal data” means collecting, recording, organising, preserving, consulting, processing, changing, selecting, extracting, comparing, using, inter-relating, freezing, communicating, distributing, deleting and destroying data, or the combination of two or more of these operations. Processing may be performed with or without the help of electronic means or however automated means and will include also the communication thereof to the parties as detailed in the point 6) below, as well as distribution again within the framework described in point 6) of this information document, in compliance with the limits and the terms and conditions laid down in Legislative Decree No. 196/2003.

4. Data processing procedure

The personal data in question will be processed:

  1. with the support of hardcopy, IT, or telematic means;
  2. by parties authorised to perform the aforesaid tasks, identified continuously, suitably trained and informed with regard to the restraints imposed by Legislative Decree No. 196/2003;
  3. adopting security measures designed:
  • to ensure the confidentiality of the interested party to whom the data refers,
  • to prevent undue access by third parties or unauthorised persons.

5. Nature of conferment and consequence of refusing to reply, if applicable

The conferment of personal data relative to the data processing in question is voluntary, as such, but the relative refusal, even only partial refusal in some cases (for example: recording invoices, keeping compulsory books, tax fulfilments, etc.) could render it impossible to establish or continue the contractual relationship and pursue the abovementioned purposes.

6. Communications and distribution

The personal data subject to processing will be communicated and/or distributed to:

  • member companies of the COOPER group, subsidiary or associated companies of COOPER CSA, also located outside the European Union;
  • banks;
  • commercial information companies;
  • legal, tax and commercial companies or consulting offices;
  • public authorities or administrations with regard to legal fulfilments;
  • couriers, forwarding agents and consignees.

7. Rights as laid down in Article 7 of Legislative Decree No. 196/2003

The party involved in the data processing in question shall be acknowledged the right as laid down in Article 7 of Legislative Decree No. 196/2003.

8. Holder and managers

The holder of the data processing function is COOPER CSA, represented by its Procurator pro tempore, Mr. Antonio Curci.
The person with responsibility for processing your personal data is Antonio Curci.
